1. THE PROMOTER

The promoter is: Fiverr International Ltd. of 8 Eliezer Kaplan Street, Tel Aviv, 6473409 Israel, referred to herein as “Fiverr”.

2. THE STUDY

2.1 The title of the study is “Share Your Insights - Freelancer Marketplaces Experience Study” (the “Study”).

2.2 The Study begins on May 12, 2025, at 10:00 am ET and ends on May 31, 2025, at 23:59 ET (the “Study Period”). Fiverr is not responsible for late, incomplete, misdirected or delayed entries, including entries not timely received due to internet failures or disruptions, or ISP problems. Incomplete information, regardless of cause, may result in the disqualification of an entry.

2.3 By participating in the Study, you accept and agree to be bound and abide by these Study Terms and Conditions and the reasonable decisions of the Evaluators (as defined below), which are final and binding in all matters. In the event that you are utilizing translated renditions of these Study Terms and Conditions, it is imperative to note that in case of any inconsistencies or conflicts, the English version shall supersede and govern.

2.4 Fifteen (15) interview participants will be chosen from those who submitted to the Study during the Study Period, based on the criteria listed in section 5.1 below (each an “Interview Participant”, and collectively the “Interview Participants”).

2.5 Any term not defined herein shall have the meaning defined in Fiverr’s Terms of Service available at https://www.fiverr.com/legal-portal/legal-terms/terms-of-service (“Fiverr’s Terms”).

3. HOW TO ENTER

3.1 To enter the Study, participants must fill out and submit all the required fields in the Preliminary Questionnaire available via the survey invitation email (the “Preliminary Questionnaire”).

3.2 Preliminary Questionnaires may only be accepted in the English language.

3.3 No purchase, payment or consideration is necessary to enter the Study.

3.4 Fiverr will not accept responsibility for submissions and/or entries that for any reason got lost, damaged or delayed in transmission, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, network, server, computer hardware or software failure of any kind.

3.5 By submitting a Preliminary Questionnaire you are agreeing to be bound by these Study Terms and Conditions and are warranting that the information provided in your Preliminary Questionnaire is accurate and complete.

4. ELIGIBILITY

4.1 The Study is only open to an active and non-active Clients who received the dedicated survey invitation email announcing the Study. The following persons are not eligible to apply:

(a) employees of Fiverr or its holding or subsidiary companies;
(b) employees of agents or suppliers of Fiverr or its holding or subsidiary companies, who are professionally connected with the Study or its administration;
(c) members of the immediate families or households of (a) and (b) above; or
(d) users who are subject to any economic sanctions or trade restrictions imposed by the United States, European Union or any other applicable jurisdiction.

4.2 In entering the Study, you confirm that you are eligible to do so and eligible to claim any Gift Card (as defined below) you may be awarded. Fiverr may require you to provide proof that you are eligible to enter the Study.

4.3 Fiverr will not accept Study entries that:

(a) use a false name or e-mail address;
(b) are automatically generated by a computer or software;
(c) are completed by third parties or in bulk;
(d) are illegible, have been altered, reconstructed, forged or tampered with; or
(e) are incomplete.

4.4 Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 Fiverr reserves all rights to disqualify you if: there is any reason to believe that you have violated these Study Terms and Conditions or Fiverr’s Terms; your conduct is contrary to the spirit or intention of the Study; you use multiple accounts to enter the Study.

4.6 By entering the Study, you undertake that any content you submit and/or publish in connection to the Study may not:

(a) contain any material that is defamatory, obscene, profane or offensive;
(b) contain any false, unsubstantiated or unwarranted claims for any product or services;
(c) contain any false or misleading statement or representation, including, but not limited to providing a false name or e-mail address;
(d) advertise any habit-forming drug, tobacco product, weapon, firearm or ammunition;
(e) violate the rights of any person, entity, firm or corporation, including intellectual property rights and any copyright;
(f) violate the rights of any person, entity, firm, corporation or any other third party, including intellectual property rights and any copyright;
(g) disparage or libel any competitor’s products, or;
(h) depict the consumption of alcoholic beverages in violation of applicable law. Breach of the above will result in disqualification.

4.7 Fiverr reserves the right to exclude a participant who violates these Study Terms and Conditions or Fiverr’s Terms, tampers with the Study or makes false statements or statements that violate applicable law or the rights of third parties or go against the spirit of the Study. If an entrant is disqualified, prizes and benefits may be revoked and subsequently claimed. In this case, Fiverr may select a new alternative Interview Participants, subject to Fiverr’s sole discretion, based on the same judging criteria.

5. SELECTION OF INTERVIEW PARTICIPANTS

5.1 The fifteen (15) Interview Participants will be selected based on their answers to the Preliminary Questionnaire regarding their usage habits on the various freelancer marketplaces and the services rendered to them in such marketplaces. Each Interview Participant shall be invited to a one-on-one interview call with a Fiverr Research team member (the “Interview”).

5.2 By this Interview, certain information relating to Fiverr’s business (the "Information") may be disclosed to you for the purpose of providing feedback to us during the Interview. Fiverr see this Information as sensitive and classified material that you cannot disclose to anyone without Fiverr’s permission. You undertake to maintain the Information in strict confidence, not disclose the Information to anyone and not to use the Information for any purpose other than participating in this Interview.

5.4 Fiverr may use any feedback you provide us about any of our services or products without any limitation. You grant Fiverr all rights, title and ownership of such feedback. You will not acquire any rights or licenses in any of our services or in any of our IP through your provision of feedback to us.

5.5 The Interview will be conducted by a Fiverr Research team member or by a 3rd party on Fiverr’s behalf and will be recorded and used for Fiverr’s internal purposes only, as further detailed in our Privacy Policy, available at https://www.fiverr.com/legal-portal/privacy/privacy-policy, which applies to your Interview.

5.5 The Interview Participants will be determined by Evaluators appointed by Fiverr from its Research team, at Fiverr’s sole discretion (the “Evaluators”).

5.6 Fiverr reserves the right to add evaluation rounds for selecting the Interview Participants, at Fiverr’s sole discretion.

5.7 The decision of the Evaluators is final and no correspondence or discussion will be entered into.

5.8 Fiverr reserves the right to extend or change any deadline periods.

5.9 Fiverr will make available upon request the surname of the Interview Participants. Requests should be sent to fiverr-care@fiverr.com.

6. THE PRIZES

6.1 Each Interview Participant, who fully completed the Interview, will be awarded with a US $30 Amazon.com Gift Card (each a “Gift Card”, and collectively the “Gift Cards”).

6.2 Eligibility for a Gift Card is contingent upon the completion of the Interview, to Fiverr’s Research team full satisfaction. An Interview Participant that will not fully complete the Interview will not be entitled for the Gift Card.

6.3 Fiverr’s Research team may stop an Interview with an Interview Participant at any time, if they suspect, at their sole discretion, that the Interview Participant has made any false or misleading statement or representation in its answers to the Preliminary Questionnaire. In such case, the Interview will be terminated, and the Interview Participant shall not be entitled to the Gift Card.

6.4 The Gift Card will be sent directly to each Interview Participant via Fiverr email account within twenty (20) business days from the day the Interview call was completed.

6.5 The Gift Card may be used only in accordance with and subject to the terms of Amazon.com Balance and Amazon.com Gift Card Terms and Conditions available at https://www.amazon.com/gp/help/customer/display.html?nodeId=3122091 (“Amazon Terms”).

6.6 Fiverr bears no responsibility or liability for any aspect of the Gift Card, including but not limited to its availability, terms, quality, or fulfillment, as these are governed by Amazon Terms.

6.7 The Gift Card is personal and cannot be shared with any third parties.

6.8 The Gift Cards are as stated, must be accepted as awarded, and are not negotiable or transferable or refundable.

6.9 The Gift Card may not be exchanged for cash value.

6.10 Any Interview Participant may only be awarded once.

6.11 All taxes, duties, fees or other expenses associated with the Gift Cards are the sole responsibility of the Interview Participants.

6.12 To receive the Gift Card, each Interview Participant agrees to provide any documents and/or information required by Fiverr, including to complete, sign and return an affidavit of eligibility and liability/publicity release, if requested.

7. CLAIMING AND DELIVERING THE GIFT CARD

7.1 Interview Participants will be contacted via their Fiverr email by May 31, 2025 (the “Announcement Date”). *Participants who do not become Interview Participants, will not receive any notice stating so.

7.2 An Interview Participant’s Gift Card may be forfeited upon the occurrence of any of the following: (i) failure of an Interview Participant to return any required documents and/or information reasonably requested by Fiverr to provide the Gift Card; (ii) determination by Fiverr that an Interview Participant is ineligible or otherwise not in compliance with these Study Terms and Conditions or Fiverr’s Terms;

7.3 In the event of Gift Card forfeiture, the Evaluators may select an alternative Interview Participant among the eligible participants, based on the same selection criteria.

7.4 The Gift Card may not be claimed by a third party on the Interview Participant’s behalf.

7.5 Fiverr does not accept any responsibility if the Interview Participant fails to take up and/or exercise the Gift Card.

8. LIMITATION OF LIABILITY

IN NO EVENT WILL FIVERR BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF: (1) PARTICIPANT’S PARTICIPATION IN THE STUDY, (2) THE NATURE OR QUALITY OF ANY PRIZES AWARDED, (3) PARTICIPANT’S ACCESS TO OR USE OF FIVERR’S WEB SITES OR THIRD-PARTY APPLICATIONS, (4) THE ACCESSING, DOWNLOADING AND/OR PRINTING OF ANY MATERIAL AVAILABLE ON SAID SITE; OR (5) THE EXERCISE OF THE PRIZES. WITHOUT LIMITING THE FOREGOING, EVERYTHING OFFERED ON FIVERR’S WEBSITES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES OR EXCLUSIONS OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.

Each participant hereby remises, releases and forever discharges Fiverr and its respective officers, directors, employees and representatives from any and all liabilities arising or relating to the Study, and hereby indemnifies and holds harmless Fiverr from and against all claims, liabilities, damages or losses of any kind. Both the foregoing release and indemnity include injury, death and property loss, arising from or in connection with: (i) acceptance, possession, use or misuse of any Gift Card; (ii) participation in the Study or any Study-related activity, as well as claims based in whole or in part, directly or indirectly, upon receipt, enjoyment, ownership, possession, use, misuse or inability to use any Gift Card; (iii) whether under contract, tort (including negligence), warranty or any other applicable sources of law; (iv) any condition caused by events beyond Fiverr’s control that may cause the Study to be disrupted or corrupted; and (v) any printing or typographical errors in any materials associated with the Study, if applicable.

ANY ATTEMPT BY A PARTICIPANT OR ANY THIRD PARTY TO CIRCUMVENT, TAMPER, DISRUPT OR DAMAGE THE STUDY ENTRY PROCESS, THE FIVERR WEBSITES OR SYSTEMS, DEFRAUD OR GAIN AN UNFAIR ADVANTAGE, ENGAGE IN UNSPORTSMANLIKE, DISRUPTIVE, ANNOYING, HARASSING OR THREATENING CONDUCT, OR OTHERWISE UNDERMINE THE FAIRNESS, INTEGRITY AND LEGITIMATE OPERATION OF THE STUDY, WILL RESULT IN AUTOMATIC DISQUALIFICATION FROM THE STUDY AND MAY CONSTITUTE A VIOLATION OF CRIMINAL AND CIVIL LAWS. FIVERR RESERVES ALL RIGHTS, INCLUDING ITS RIGHTS TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES), TO THE FULLEST EXTENT OF THE LAW, INCLUDING THE POSSIBILITY OF REFERRAL FOR CRIMINAL PROSECUTION.

The Study is not affiliated with, sponsored by or endorsed by any other person or entity except Fiverr.

9. DATA PROTECTION

9.1 Fiverr will only process any personal information you provide as set out in Fiverr’s Privacy Policy.

9.2 Fiverr will process your personal data included in the Preliminary Questionnaire and in the Interview for the purposes of running, evaluating, and administering the Study, which is necessary for the purposes of compliance with Fiverr’s obligations hereunder.

10. GENERAL

10.1 If there is any reason to believe that there has been a breach of these Terms and Conditions or Fiverr’s Terms, Fiverr may, at its sole discretion, reserve the right to exclude a participant from participating in the Study.

10.2 Fiverr reserves the right to hold void, suspend, cancel, or amend the Study and/or change these Terms and Conditions and/or extend or change any deadline periods, at any time, without notice nor obligation to justify the decision and Fiverr will not be held responsible for it.

10.3 By participating in the Study, each participant acknowledges they have read, understand and will abide by these Terms and Conditions. All issues and questions concerning the construction, validity, interpretation, and enforceability of these terms, and the rights and obligations of applicants and Fiverr in connection with the Study, shall be governed by and in accordance with the laws of the State of Israel without regard to conflict of laws principles thereof, and only the competent courts located in Tel Aviv shall have jurisdiction in any conflict or dispute arising out of this Study.
